The judgment pointed out that when Shih arrived at the golf course on November 20, 2023, the lobby was undergoing water removal operations. At that time, Shih slipped due to the wet floor, resulting in head and neck injuries. The amount he claimed from the golf course included medical expenses of 62,865 NT dollars, future medical expenses of 342,000 NT dollars, losses due to inability to work totaling 1,651,502 NT dollars, and mental distress compensation of 500,000 NT dollars, totaling 2,556,367 NT dollars.
During the hearing, the golf course argued that there were 3 to 4 cleaning staff present at the time of the incident and that Shih slipped because he was looking at his phone, which was unrelated to the golf course. Upon review, the judge found that although there were warning signs at the scene, there were no restricted areas cordoned off, concluding that the golf course was negligent in preventing the accident. Additionally, the golf course pointed out that the medical diagnosis certificate mentioned “required 3 months of rest,” which only limited activities to "limited activities," such as going to the restroom and eating, but Shih immediately engaged in daily activities and playing golf after the incident, indicating that he did not require long-term medical care.
The Tainan District Court held that Shih participated in a golf tournament on the same day he received medical advice on December 11, 2023, and played golf a total of 26 times in areas including Changhua and Taichung after the incident. Since the action of playing golf requires rapid movement of the neck and body, it clearly did not conform to the medical advice for "limited activity." The judge determined that Shih's injuries affected his daily life and work, ruling that the period of injury lasted from November 20 to December 10, 2023, a total of 21 days, with losses amounting to 223,282 NT dollars, and ultimately determining that both parties should bear 50% of the responsibility, with the golf course needing to compensate 111,641 NT dollars, and the judgment is subject to appeal.
