An 87-year-old man went out to buy groceries on an electric bike but suddenly felt unwell and fell to the ground. Although passersby noticed, no one dared to step forward to help; even a child who wanted to assist the elderly man was discouraged. After the man passed away, his family felt angry at the indifference of the bystanders and filed a lawsuit seeking compensation. However, the court rejected the request, stating that bystanders had no obligation to assist, which sparked social attention.
An 87-year-old man rode his electric scooter to buy groceries, but on the way, he felt unwell and immediately fell to the ground. This elderly man, from Shandong Province in mainland China, was generally in good health and often went out for activities. Due to his children being busy with work, although they were concerned about his safety, he insisted on going out alone, and the children could only support him silently.
According to reports, when passersby noticed the elderly man lying on the ground, they all slowed down to check on him, but no one took the initiative to help. Most people just observed from a distance and hurriedly left. There was a boy who wanted to offer help but was discouraged by others, who said, "This old man is just trying to scam us." Some passersby hesitated for a moment but ultimately chose to leave.
The family of the elderly man was extremely saddened by his passing and felt anger towards the indifference of the passersby. Through surveillance footage, they sued the 10 bystanders on-site, seeking 140,000 RMB from each for a total of 1.4 million RMB, believing that these people's neglect was responsible for the man's death.
This case sparked widespread attention, and after a detailed investigation and hearing by the court, the family’s lawsuit was ultimately dismissed, and the 10 passersby were not required to bear any compensation responsibility. The judge pointed out that the bystanders did not have direct contact with the elderly man, and according to Article 184 of the Civil Code, ordinary citizens do not have a duty to rescue, thus these 10 bystanders did not fall under the legal obligation to assist.
