The man, surnamed Su, left the country in 2010 under the pretext of studying and continued his education abroad. However, after turning 30, he did not return to Taiwan to serve as required, and despite being urged three times by the district office, he still failed to report back and only returned to Taiwan at the age of 39. Recently, the court sentenced Mr. Su to three months in prison, which may be converted to a fine, and he has the right to appeal.
According to the court's judgment, Mr. Su was approved to leave the country for studies on September 18, 2010, and did not return until he was 39. During this period, the Zhongshan District Office had urged him three times, but he did not comply with the regulations and failed to fulfill his conscription duties, which led to the Taipei City Government referring the case for investigation.
It is understood that Mr. Su violated Article 48, Paragraph 2, Subparagraph 2 of the Enforcement Law of the Military Service Act and Article 5, Paragraph 1, Subparagraph 2 of the Regulations on Overseas Study for Conscripts, which limits the maximum age for studying in a doctoral program abroad. The prosecution thus charged him with evading conscription.
The judge indicated during the proceedings that Mr. Su's actions violated Article 3, Subparagraph 7 of the Act for Punishing Obstruction of Military Service, which interfered with the handling of conscription for conscripts, undermined the fairness of the military service system, and impaired potential national defense mobilization capabilities. Ultimately, based on Article 3, Subparagraph 7 of the Act for Punishing Obstruction of Military Service, he was sentenced to three months in prison, which may be converted to a fine and is subject to appeal.
