In another case, after a Japan Airlines flight landed, flight attendants found cigarette butts in the restroom and also notified the police for investigation. Furthermore, a woman with dual citizenship from Taiwan and the United States triggered an alarm by smoking an electronic cigarette on a flight and was similarly charged with a violation. All these cases highlight the prohibition of using devices that interfere with aircraft operation on board.
A Malaysian man took an EVA Air flight to Taiwan last November, but during the flight, he could not resist his nicotine cravings and smoked an e-cigarette in the economy class seat. Afterwards, the Taoyuan District Prosecutor's Office filed a lawsuit against him for violating the Civil Aviation Act.
The man smoked in the economy class of EVA Air 75 minutes before the flight ended, and was discovered by a flight attendant who issued a warning and subsequently notified the aviation police for handling. The Taoyuan District Prosecutor's Office conducted an investigation into this case and prosecuted the man under the Civil Aviation Act.
Not long ago, another flight from New Chitose Airport in Japan arrived at Itami Airport, where flight attendants found cigarette butts in the restroom and immediately reported it to the police, causing all passengers to be unable to disembark immediately and forcing them to wait for police inspection.
Additionally, China Airlines flight CI23 took off from California in February of this year, during which a woman holding dual citizenship of Taiwan and the United States privately smoked an e-cigarette in the restroom due to her nicotine cravings, triggering the smoke alarm, and she was ultimately prosecuted under the Civil Aviation Act.
Regarding the incident involving Malaysian citizen NG WAI HOONG taking EVA Air flight BR228 for a business trip on November 25, 2024, the prosecutor believed that he smoked an e-cigarette in the economy class at 6:50 PM that evening, despite being aware of the prohibition on using any devices that could interfere with flight and communication during the flight. He was stopped by the flight attendant, which clearly violated Articles 43-2 and 102 of the Civil Aviation Act. The confiscated e-cigarette from the case has also been seized, and a simplified judgment has been recommended.
